This short essay attempts to reveal a more precise meaning of the US Constitution’s Article VI concerning a portion of the document’s declaration of being the Supreme Law of the Land.
Let’s begin with that portion, Article VI Clause 2, which states the following:
This Constitution and the Laws of the United States shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, anything in the Constitution or Laws of any State to the Contrary notwithstanding.
If one takes a closer look, it clearly says that all laws and treaties (note that treaties can be made by the President only with advice and consent of the Senate with two-thirds of the Senators present that concur; see Article II section 2). Was
the US-Iran Nuclear deal done this way, or was it renamed something other than a Treaty (all agreements with foreign nations are Treaties) to allow the President and his administration to create such a thing? Maybe it was called an Executive
Order or Agreement to circumvent the Constitution.
Nevertheless, only Federal Laws and Treaties are legal if they are made in the Constitution as written.
Okay, we have briefly addressed Treaties, but what about the Laws?
Our introduction of Article VI clause 2 above is called ‘The Supremacy Clause.’
Many immoral and corrupt politicians have, over time, via lies and dumbing down our education systems, convinced most US citizens that this means if any State has issues with any Federal law, then the Feds have the supremacy, and the law stands. The State loses. This is only true if the law was made IN PURSUANCE of the Constitutional clause at hand!
PURSUANCE means:
1. Webster’s dictionary – the act of pursuing especially: a carrying out or into effect: prosecution in furtherance of his duties
2. Cambridge Dictionary – the act of trying to achieve something
Therefore, the term Pursuance means supporting, building up, and setting in stone the Constitutional clause in question. An example would be the latter part of the Second Amendment stating:
“… the right of the people to keep and bear Arms, shall not be infringed” (meaning shall not be messed with.)
If laws were made in Pursuance of this, then they all would be to support, build up, set in stone, not tear down per what has happened and is happening today! Thus, one could make the case that most, if not all, Federal and State laws concerning the Second Amendment are violations and illegal per the Supreme Law of the land.
Isn’t it time to wake up and educate ourselves (you don’t have to be a scholar) on the true meanings of our God-given rights enumerated in the US Constitution which contends to chain men down to its writings so that all men can choose life,
liberty, and the pursuit of happiness in the United States of America?
Thomas Jefferson stated how to understand the Constitution’s clauses, i.e., don’t try to interpret it, but go back to the founders’ meanings:
On every question of construction, carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates, and instead of trying to what meaning may be squeezed out of the text or invented against it, conform to the probable one in which it was passed” –Thomas Jefferson to William Johnson, 1823. ME 15:449
And John Adams warned us of what we find ourselves in today:
“Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other”. John Adams May God help us all!
